Terms & Conditions

Prospective purchasers (Purchasers) should read the following disclaimer and confirm their acceptance of these terms before proceeding to use the Everleigh Interactive Mapping System (System).

Use of the System is deemed acceptance of these Terms and Conditions:

  1. The System is for marketing purposes only and is not intended to be relied upon when making a decision to purchase a lot in the Everleigh development (Everleigh).
  2. Purchasers are expected to undertake their own due diligence searches, including those carried out via their solicitor or conveyancer when making a decision to purchase. The System is not intended to replace the usual due diligence searches undertaken by Purchasers.
  3. The System includes, but is not limited to, various documents including maps, design documents, contract documents, technical documents and facts sheets (Data). To the extent that any of the Data has not been prepared by the developer, Mirvac Qld Pty Ltd (Mirvac), Mirvac is merely passing on third party Data, which should not be relied upon without further due diligence by the Purchaser.
  4. The Proposed Services and Other Features mapping elements/overlay, the As Constructed Plans and the fact sheets are indicative only and Purchasers should satisfy themselves of these services and other features by undertaking a “Dial Before You Dig” search before making any decision to purchase.
  5. The proposed landscaping is indicative only.
  6. The contents of the System (including documents available for download) are subject to copyright and are protected by the laws of Australia including the Copyright Act 1968 (Cth) and in other countries via international treaties.
  7. The System and Data is for personal use only for prospective Purchasers of lots in Everleigh.
  8. The System and Data must not be:
    • utilised for commercial purposes;
    • collected and on sold or distributed without the permission of Mirvac; or
    • used for any other purpose which is not a personal use.
  9. Whilst care has been taken to ensure that the Data is accurate, Mirvac do not represent or warrant the accuracy, reliability, completeness or suitability of any of the information and documents accessible via the System.
  10. Mirvac do no accept any liability (including without limitation, liability in negligence) for any loss, damage or costs (including consequential damage) relating to any use of, or reliance on, the Data obtained via the System.
  11. Purchasers should make their own enquiries and where applicable, obtain appropriate professional advice as to their particular circumstances. All purchases are subject to contract terms.
  12. All matters relating to the System are governed by the laws of Queensland.
